LeafPulse ("LeafPulse," "we," "us," or "our") is a cannabis retail analytics platform that provides dispensary owners and operators with business intelligence derived from their point-of-sale (POS) data.
The Service includes: real-time inventory velocity tracking, margin analysis and optimization, trend detection, dead inventory identification, cross-location performance comparison, cash reconciliation, and related reporting and alerting tools.
Read-only by design. LeafPulse connects to your POS system using read-only credentials. We can read your data and surface insights. We cannot create, modify, or delete transactions, inventory records, or any compliance-related data in your POS system.
By accessing or using the LeafPulse platform, you agree to be bound by these Terms of Service. If you are entering into this agreement on behalf of a business entity, you represent that you have the authority to bind that entity.
If you do not agree with any part of these terms, you may not use the Service.
One account per business. Each dispensary business entity is entitled to one LeafPulse account. Individual locations within a multi-location operation are managed under a single account.
Authorized users. You are responsible for all activity that occurs under your account. You may grant access to employees and managers, but you remain responsible for ensuring authorized users comply with these Terms.
Account security. You must maintain the confidentiality of your account credentials. Notify us immediately at legal@leafpulse.io if you suspect unauthorized account access.
Accurate information. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
Pricing:
Billing. Subscriptions are billed monthly in advance. Your billing cycle begins on the date your account is activated. All fees are non-refundable except as required by applicable law.
Payment. Payment is due upon billing. LeafPulse reserves the right to suspend or terminate your account for non-payment after reasonable notice.
Cancel anytime. You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of your current billing period. No long-term contract or cancellation penalty.
Price changes. We will provide at least 30 days' notice before changing our pricing. Continued use after the effective date constitutes acceptance of the new pricing.
Your data belongs to you. All POS data, transaction records, inventory data, and business information you provide or that is pulled from your POS system remains your property at all times.
Read-only POS access. LeafPulse accesses your POS data using read-only API connections or secure data exports. We do not write to, alter, or delete data in your POS system.
We do not sell your data. LeafPulse will never sell, rent, or trade your business data or customer data to third parties. Full stop.
Aggregate analytics. LeafPulse may use aggregated, de-identified, non-attributable data (e.g., industry-wide trend patterns) to improve the Service. This data contains no information that identifies your business or your customers.
Data processing. By using the Service, you authorize LeafPulse to access, store, process, and analyze your POS data solely for the purpose of providing the Service to you.
LeafPulse IP. The LeafPulse platform, software, algorithms, dashboards, visual design, and all associated intellectual property are owned by LeafPulse. These Terms do not grant you any rights to our intellectual property beyond the limited license to use the Service.
Your license to use the Service. LeafPulse grants you a limited, non-exclusive, non-transferable, revocable license to use the Service during your subscription term, solely for your internal business operations.
Your content. You retain all rights to your data. You grant LeafPulse a limited license to process your data solely to provide the Service.
You agree not to:
No warranty. The Service is provided "as is" and "as available." LeafPulse makes no warranties, express or implied, regarding the accuracy, completeness, or fitness of the Service for any particular purpose.
Business decisions. LeafPulse provides analytics and insights to inform your business decisions. You remain solely responsible for all business decisions made in connection with or based upon information from the Service.
Limitation. To the maximum extent permitted by law, LeafPulse's total cumulative liability to you for any claim arising out of or related to these Terms or the Service will not exceed the fees you paid to LeafPulse in the three (3) months preceding the claim.
Exclusions. LeafPulse will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, even if LeafPulse has been advised of the possibility of such damages.
By you. You may terminate your account at any time. Upon termination, your access to the Service will end at the close of your current billing period.
By LeafPulse. We may suspend or terminate your account for: material breach of these Terms, non-payment, use of the Service for unlawful purposes, or any conduct we determine poses risk to the Service or other users.
Effect of termination. Upon termination, your license to use the Service ends immediately. LeafPulse will delete your data within 90 days of account closure in accordance with our Privacy Policy.
Survival. Sections on Data Ownership, Intellectual Property, Limitation of Liability, and Governing Law survive termination.
Governing law. These Terms are governed by the laws of the State of New Mexico, without regard to conflict of law principles.
Disputes. Any dispute arising out of or relating to these Terms or the Service will first be subject to good-faith negotiation between the parties. If unresolved, disputes will be submitted to binding arbitration under the American Arbitration Association Commercial Arbitration Rules.
Class action waiver. You agree to resolve disputes individually and not as part of any class or representative proceeding.
We may update these Terms from time to time. We will provide notice of material changes via email or a prominent notice within the Service at least 30 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
